The civil case against pop star Michael Jackson and Marian Medical Center may not happen, according to the defendant's attorney.

The family of Manuela Ruiz says the 74-year-old patient was pushed out of her hospital room to make space for Jackson back in 2005. Ruiz later died.

Maria Ortiz, along with Rosa and Marcos Meraz, are suing over what they say was preferential treatment.

But the plaintiffs did not appear in court Monday. The hospital's attorney says they have not secured a lawyer.

A statement released by the hospital to Action News says:

"Patient care and safety is always our first priority at Marian. We have always been confident the care provided to Mrs. Ruiz was exceptional. We continue to express our sympathy to the Ruiz family."

^ I can understand perfectly how it went to court, because they are alleging the woman was moved out of her room in favour of Michael. But if true, it's the Hospital's fault, not Michael's :yes:

Jackson dropped from Marian lawsuit

Pop star Michael Jackson is no longer named as a defendant in a lawsuit that alleged intentional infliction of emotional and mental distress by Jackson, Marian Medical Center and Catholic Healthcare West.

The suit was filed by the family of a Santa Maria woman who died at the hospital in February 2005.

Superior Court Judge Rodney Melville granted a demurrer today that was filed by Jackson’s attorney, Timothy Gorry, of Los Angeles.

Allegations remained against the hospital.

The lawsuit also alleges elder abuse against 73-year-old Manuela Gomez Ruiz on the part of the hospital, which according to the complaint moved Ruiz while she was being treated to make space for Jackson to be examined when he was brought to the hospital in 2005.

Ruiz died at Marian Medical Center shortly after she was reportedly moved to another hospital room to make room for Jackson.

Makes full sense to me. It wasn't Michael's decision even if it was true. If it is true then it is terrible, as much as I love Mike - if one of my relatives got moved to make way for him I wouldn't be happy (well it depends which relative!)

That is rediculous. Like Marni said, if it was anyones fault it was the hospitals..Anyone in their right mind could see that. But obviously they just wanted to take a shot at Michael. Which is stupid. Yes they had a great loss in their family but if they are going to sit around and point fingers then Michael is not the one to be pointing them at.

Judge Rodney Melville dropped Jackson from the lawsuit against Marian Medical Center in response to a challenge from Jackson's attorney on Tuesday (April 8), reports the Associated Press.

In the suit, Manuela Gomez Ruiz's family claim the gravely ill patient was moved from her two-bed trauma unit to make room for Jackson when he arrived with flu symptoms during his 2005 molestation trial.

Ruiz suffered a heart attack and died later that day.

The hospital's attorney attempted to file a similar motion to be dropped from the lawsuit, but it was reportedly rejected by the judge.

I do sympathize with the loss of the family's loved one but Michael should never have been included in this law suit.

Totally I agree, but because it was Michael they are making a big deal if it wasn't a famous person they would not bother and it would not be in the papers.

Then again Michael is entitled to treatment like anyone else plus considering the time when it happened there was no where else for Michael to go because of the trial etc. Yes my sympathy goes to the family but they should not blame Michael, he is again a victim and they are just after $$$.

I hope this will clear up any confusion ALyssa.

Here is some background information as to what caused the lawsuit to be filed against MJ.

"During his highly publicized trial, which lasted for months and ultimately resulted in his acquittal on child-molestation charges, Jackson was taken to the hospital on Feb. 15, 2005, complaining of flu-like symptoms.

Ruiz, who was on life-support after a massive heart attack, was moved from a two-bed trauma room so that Jackson could privately occupy the room, according to court documents filed on behalf of the plaintiffs.

Ruiz was moved to an exam room, kept alive by hand-pumped oxygen until she could be reconnected to life-support machines, according to the plaintiffs.
She died later that evening."

Her survivors blamed the hospital and MJ for her death and filed a lawsuit against them claiming that:

“The Jackson Defendants and the Hospital Defendants prevented the Plaintiffs and other close family members of Manuela from walking through the hallway to Manuela's new room, as would be common and necessary for relatives of a sick and/or dying patient, had not the Hospital Defendants allowed the Michael Jackson Defendants to commandeer the Hospital,” McKiernan wrote in the revised complaint.

“The Plaintiffs were emotionally and mentally traumatized as they saw the critically-ill Manuela being recklessly hustled out of the Trauma Room and aimlessly shuttled through the Hospital's hallway,” McKiernan wrote, “so that Michael Jackson, appearing ambulatory, healthy and well, but claiming ‘flu-like' symptoms, could have both beds in the small Trauma Room to himself ... in order to protect his ‘privacy.'”

According to Judge Melville Michael Jackson did not cause the patient's death and dropped him from the lawsuit. So good news for MJ.

it is sad that these lawers go after somebody who is first all innocent and pure and
second they go after him just because there afraid of loosing money.
I am sorry for the ppl who lost somebody but don't blame Michael Jackson for
any thing blame the hospital for there wrong doings but I am glad the judge
saw that Michael didn't anything wrong and dropped him out of it .

According to the above article Judge Melville did officially retire October, 2007 but he planned to continue duties until a new judge is hired. This explains why he was still on this case.
